Many businesses on the Internet advertise as part of their asset protection service internally, as an employer of security guards, undertakes the operation of condominium camera systems.
In many cases, when browsing the Internet, we find information according to which only a property guard can be the operator of such systems. However, this does not correspond to reality, there is a considerable slippage in it. All of this is sufficiently suitable for deceiving the representatives of apartment buildings.
In order to recognize this, it is worth studying the legislation (Act CXXXIII of 2003 on condominiums, Act CXXXIII of 2005 on the rules of personal and property protection and private detective activity), if only because the profession its practitioners do not always agree on this issue either.
For us, the wording of the legislation was clear, but since it divided opinions in our environment, we requested an official position from the officials of the Budapest Police Headquarters and the Professional Chamber of Personal, Asset Protection and Private Investigations.
Both resolutions clearly establish that the legislation really requires some clarification, but regardless of this, the operation of apartment building camera systems is a
"In possession of a valid safety engineering designer or installer certificate issued before January 1, 2012, or asset protection system installer or asset protection system designer or installer certificates issued after that date can be done".
Of course, this is not sufficient to carry out the activity, since if the service is provided within the framework of a business, then the business must have an official certificate issued by the police. The company is obliged to report this to the police before starting the design-installation activity, which issues it as proof of registration.
In addition, camera operators as data controllers are also subject to a notification obligation, according to which the data controller handling personal data must notify the National Data Protection and Freedom of Information Authority for registration in accordance with Act CXII of 2011 on the right to self-determination and freedom of information. defined by law.
If these conditions are fulfilled, those engaged in property protection (security) design and installation activities can also operate apartment building camera systems, so they can provide a full range of services from installation to maintenance and operation.
Of course, this does not affect the rights of those performing asset protection activities (asset guards) defined by law.
